These Terms of Use ("Terms") govern your access to and use of Sudokitty, including our website and mobile application (together, the "Services"), offered by Bridgeful ("Bridgeful," "we," "us," or "our"). By downloading, accessing, or using the Services, you agree to these Terms and to our Privacy Policy, which is incorporated by reference.
1. Who we are
Bridgeful is located at 26 Botanical Vista Dr, Tomball TX 77375. You may contact us at hello@sudokitty.com.
2. The Services
"Sudokitty" refers to our sudoku game and related features made available through our website and through distribution platforms such as the Apple App Store. Features may change over time.
3. Eligibility
The Services are intended for users who meet the minimum age required by the platform you use (for example, Apple's requirements for your region) and any higher age required by applicable law. If you are not old enough to enter into a binding agreement where you live, you may not use the Services. Parents and guardians are responsible for minors' use of the Services.
4. License to use the Services
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to access and use the Services for your own non-commercial entertainment, in accordance with these Terms and with the rules of any app store or platform through which you obtain the app.
You agree not to:
- Copy, modify, distribute, sell, lease, or reverse engineer any part of the Services, except where allowed by law;
- Interfere with or disrupt the Services, servers, or networks;
- Use cheats, exploits, automation, or other means intended to gain an unfair advantage or harm other users' experience;
- Use the Services for any unlawful purpose or in violation of third-party rights.
5. Intellectual property
The Services, including software, artwork, audio, branding, text, and other materials, are owned by Bridgeful or our licensors and are protected by intellectual property laws. Except for the limited license above, no rights are granted to you. Trademarks and trade dress may not be used without our prior written permission.
6. Purchases and subscriptions
Certain features may be offered for purchase or subscription within the app. Payments are processed by third parties (for example, Apple via the App Store). We use RevenueCat and related tools to manage entitlements and subscription status. Your purchase relationship is also subject to the applicable platform's terms and payment policies.
To the extent permitted by law, fees are non-refundable except as required by applicable law or the platform's policies. Subscriptions may renew automatically until cancelled in your account settings on the platform. Pricing and availability may change.
7. Third-party services
The Services rely on service providers such as hosting and backend infrastructure (for example, Supabase for certain game data and features) and subscription management (RevenueCat). Their use of data is described in our Privacy Policy and, where applicable, their own terms.
8. User content and feedback
If you submit feedback, support requests, or other content to us, you grant us a non-exclusive license to use that content to operate and improve the Services, without obligation to compensate you, except where prohibited by law.
9. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRIDGEFUL DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRIDGEFUL AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (USD $50), EXCEPT WHERE PROHIBITED BY LAW.
11. Indemnity
You will defend and indemnify Bridgeful against any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your misuse of the Services or violation of these Terms, except to the extent caused by our misconduct.
12. Termination
We may suspend or terminate your access to the Services if you violate these Terms or if we discontinue the Services. You may stop using the Services at any time. Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and governing law) will survive termination.
13. Changes to these Terms
We may update these Terms from time to time. We will post the updated version on our website and may update the "Last updated" date. If changes are material, we may provide additional notice (for example, in-app). Continued use after changes become effective constitutes acceptance of the revised Terms, to the extent permitted by law.
14. Governing law and disputes
These Terms are governed by [GOVERNING LAW / JURISDICTION], without regard to conflict-of-law rules. You and Bridgeful agree to try to resolve disputes informally by contacting us at hello@sudokitty.com first. If a dispute cannot be resolved informally, you and Bridgeful consent to the exclusive jurisdiction of the courts located in [JURISDICTION], except where applicable law requires a different forum or gives you a non-waivable right to bring a claim in your local courts or before a consumer protection agency.
15. Miscellaneous
These Terms constitute the entire agreement between you and Bridgeful regarding the Services and supersede prior agreements on this subject. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
